Lunch Seminar addressing Cook County's ordinance changes
Matt Brown of Jackson Lewis P.C.
Companies located and doing business in Glenview and other parts of Cook County will soon need to reexamine their employee sick leave policies and ensure that they are in compliance with the new Cook County Earned Sick Leave Ordinance. The Ordinance, which passed on October 5, 2016, and becomes law effective July 1, 2017, mandates that employers in Cook County, Illinois allow eligible employees to accrue up to 40 hours of paid sick leave in each 12-month period of their employment. The Cook County Commission on Human Rights has posted draft regulations that will govern its interpretation and enforcement of the Ordinance, and it has stated that it will adopt final regulations by June 1, 2017, one month before the Ordinance takes effect.
Certain municipalities in Cook County have chosen to opt out of the Ordinance, and more are currently contemplating opting out. The Ordinance has implications for employers of all sizes, however, whether or not the employer’s primary place of business is in a municipality that has opted out of the Ordinance. For example, the draft regulations indicate that, even if an employer is based in a municipality that has opted out of the Ordinance, if it has employees that sometimes work in municipalities that have not opted out, then that employer could still be covered by the Ordinance.
